1Agreement to these Terms
By creating an account, accessing or using the Service, you agree to be bound by these Terms of Use and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not access or use the Service.
If you are under 18, you should review these Terms with, and use the Service with the awareness of, a parent or guardian. If you are entering into these Terms on behalf of a school or other organisation, you confirm that you are authorised to bind that organisation.
2About the Service
ATAR Booster is an online learning platform for students studying the NSW Higher School Certificate (HSC). The Service is designed to support your study and currently provides:
- practice questions aligned to the NSW HSC syllabus, mapped to individual syllabus points;
- instant AI-assisted feedback and marking on multiple-choice and typed short-answer questions;
- adaptive practice and spaced repetition that respond to your performance;
- progress tracking, analytics and mock-exam features; and
- worked solutions, hints and explanations.
The Service currently focuses on NSW HSC STEM subjects, beginning with Biology, with further subjects and features being added over time. Some features (including any teacher, class or school features, and community features) may only be available where they have been enabled for your account. We may add, change or remove features over time, and we will give reasonable notice of material changes to core functionality where we can.
3Accounts and eligibility
- You need an account to access most features. Registration is currently available to Year 11 and Year 12 students using a recognised NSW school email address.
- You agree to provide accurate, current and complete information when you register, and to keep it up to date.
- Your account is personal to you. You are responsible for activity under your account and for keeping your login credentials secure. Do not share your account or credentials with anyone.
- Sign-in and passwords are managed by our identity provider (Auth0); please protect your credentials accordingly.
- Tell us promptly at support@atarbooster.com.au if you believe your account has been accessed without authorisation.
4Subscriptions and payments
Plans
ATAR Booster offers a paid subscription that unlocks full access to the platform. Subscriptions are currently available on the following recurring plans (in Australian dollars, inclusive of GST):
- Monthly: $60 per month;
- Quarterly: $165 per quarter; and
- Yearly: $600 per year.
Current pricing and the features included in each plan are shown on the platform at the time you subscribe, and may change from time to time.
Billing
- Payments are processed securely by our payment provider, Stripe. We do not receive or store your full card details.
- Paid subscriptions renew automatically at the end of each billing period, at the then-current price, unless you cancel before the renewal date.
- You can cancel at any time; cancellation takes effect at the end of the current billing period, and you retain access until then.
- We will give reasonable notice of any change to subscription pricing before it applies to you.
Refunds and your consumer rights
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits those rights. Refunds are otherwise handled in accordance with the Australian Consumer Law and any refund or trial terms presented at the time of purchase.
5Acceptable use
When using the Service, you agree not to:
- use the Service for any unlawful, harmful or inappropriate purpose;
- share, sell or transfer your account or login credentials;
- attempt to circumvent usage limits, access controls or security measures;
- use automated tools (bots, scrapers or similar) to access, collect or extract data or content from the Service;
- copy, reproduce, redistribute, publish or sell our questions, solutions or other content;
- submit content that is offensive, misleading, infringing or that violates another person’s rights; or
- interfere with, disrupt, or place undue load on the Service or its infrastructure.
We may remove content, and suspend or restrict access, where we reasonably believe these Terms or acceptable standards have been breached.
6Academic integrity
ATAR Booster is a study and practice tool. It is your responsibility to use it honestly and in line with your school’s and NESA’s rules on academic integrity. In particular, you agree not to:
- use the Service to complete assessments, examinations or graded work in a way that is not permitted by your school or NESA;
- reproduce, screenshot, photograph, record or redistribute our questions or solutions, including to “question banks”, study groups or other services; or
- otherwise use the Service to facilitate cheating or academic dishonesty.
Breaching this section may result in suspension or termination of your account.
7Intellectual property
Our content
All intellectual property in the Service, including questions, solutions, lessons, software, feedback systems, designs, logos and trade marks, is owned by or licensed to STEM TUTOR Pty Ltd. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal educational purposes only. You must not reproduce, distribute, or create derivative works from our content without our prior written consent.
Your content
You keep ownership of the answers and other content you submit. By submitting content, you grant us a licence to host, process and use it as needed to operate and provide the Service to you. For example, to mark your answers, generate feedback, track your progress, and produce de-identified, aggregated insights. We do not sell your content, and we do not allow AI providers to use it to train their models. See our Privacy Policy for how we handle your data.
8Privacy and data
Our Privacy Policy explains what personal information we collect, how we use and protect it, who we share it with, where it is stored, and the rights and choices you have. By using the Service, you acknowledge that we handle personal information as described in that policy.
9Availability and changes
The Service is provided on an “as is” and “as available” basis. We aim to keep it running reliably, but we do not guarantee that it will always be available, uninterrupted or error-free.
- The Service may be temporarily unavailable for scheduled or emergency maintenance, upgrades, or reasons outside our control.
- We may update, suspend or discontinue parts of the Service, and we will make reasonable efforts to notify you of significant planned changes.
10Educational disclaimer
- ATAR Booster is a supplementary study tool. It does not replace your teachers, your school, classroom instruction, or professional educational advice.
- It is not intended to be used as a school’s official assessment or record-keeping system.
- We do not guarantee any particular academic outcome, mark or result from using the Service.
- AI-generated feedback and marking are automated, may contain errors, and should be verified with your teacher. Do not rely on them as definitive.
11Limitation of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that applies to you under the Australian Consumer Law or other law and that cannot be lawfully excluded. To the maximum extent permitted by law:
- our liability for any guarantee, condition or warranty that cannot be excluded is limited (where permitted) to re-supplying the Service or paying the cost of having it re-supplied;
- we are not liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill, arising from your use of the Service; and
- our total aggregate liability arising out of or in connection with the Service or these Terms is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
12Indemnity
To the extent permitted by law, you agree to indemnify us against claims, liabilities, losses and reasonable expenses arising out of your misuse of the Service, your breach of these Terms, your breach of any applicable law or third-party right, or content you submit through the Service. This clause does not apply to the extent a loss is caused by our own breach, negligence or wrongful act.
13Suspension and termination
- You may stop using the Service and delete your account at any time by contacting support@atarbooster.com.au.
- We may suspend or terminate your access if you breach these Terms, or if we reasonably consider it necessary to protect the Service or other users. Where practicable, we will give notice.
- On termination, your right to use the Service ends. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity and governing law) will continue to apply.
- Account deletion is handled as described in our Privacy Policy.
14Governing law and disputes
- These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
- If a dispute arises, we ask that you contact us first so we can try to resolve it. The parties agree to attempt to resolve any dispute in good faith before commencing proceedings, except where urgent relief is needed.
15Changes to these Terms
We may update these Terms from time to time to reflect changes to the Service, the law, or our practices. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you through the platform or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
16General
Severability
If any provision of these Terms is found to be unenforceable or invalid, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force.
Entire agreement
These Terms, together with our Privacy Policy and any additional terms shown at the point of purchase, constitute the entire agreement between you and us regarding the Service.
Waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
